Agreement to Terms

By accessing or using the services provided by DM Aventura Concrete, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services. These terms apply to all visitors, users, and others who access or use our concrete services.

Services Description

DM Aventura Concrete provides professional concrete installation, repair, and related services for residential and commercial properties. Our services include but are not limited to driveways, patios, foundations, decorative concrete work, repairs, and other concrete-related projects.

All projects are subject to written estimates and contracts. We reserve the right to refuse service to anyone for any reason at any time. Project timelines and completion dates are estimates and may be affected by weather, material availability, site conditions, or other factors beyond our control.

Estimates and Pricing

Written estimates are provided free of charge and remain valid for 30 days unless otherwise specified. Estimates are based on site conditions as observed during the initial assessment. If conditions change or unexpected issues arise during work, additional charges may apply.

Final pricing may vary from initial estimates if project scope changes, site conditions differ from initial assessment, or client requests modifications. We will communicate any anticipated price changes before proceeding with additional work. Payment terms are specified in individual service contracts.

Client Responsibilities

Clients are responsible for ensuring clear access to work areas, including removal of vehicles, furniture, plants, or other obstacles. You must disclose any known underground utilities, irrigation systems, or other features that may affect the project. Failure to provide accurate information about site conditions may result in additional charges or project delays.

You are responsible for obtaining any necessary permits or approvals from homeowner associations, local authorities, or other governing bodies unless our contract specifically includes permit procurement. You must maintain adequate insurance on your property and notify us of any changes that might affect the project.

Warranties and Guarantees

We guarantee our workmanship for a period specified in your service contract. This warranty covers defects in installation and workmanship but does not cover damage from misuse, neglect, settling, acts of nature, or normal wear and tear. Concrete naturally develops minor cracks over time due to environmental factors and material properties.

Material warranties are provided by manufacturers and passed through to clients as applicable. Our warranty becomes void if unauthorized parties perform modifications or repairs to our work. To maintain warranty coverage, you must follow all maintenance recommendations we provide.

Limitation of Liability

To the maximum extent permitted by law, DM Aventura Concrete shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability for any claim arising from our services shall not exceed the amount paid for the specific service giving rise to the claim.

We maintain appropriate insurance coverage but are not responsible for damages to underground utilities not properly marked by utility companies, damage to landscaping or structures not included in the project scope, or delays caused by weather, material shortages, or other factors beyond our reasonable control.

Cancellation and Refunds

Clients may cancel projects before work begins with written notice. Cancellation after work has commenced may result in charges for work completed, materials purchased, and scheduling commitments made. Deposits are non-refundable once work begins or materials are ordered.

We reserve the right to cancel or postpone projects due to weather conditions, safety concerns, or other reasonable factors. In such cases, we will reschedule at the earliest opportunity. If we cancel a project before beginning work, we will refund any deposits received.

Property Access and Safety

By hiring our services, you grant us access to your property during normal business hours or as otherwise agreed. We will make reasonable efforts to secure work areas and protect your property. However, you are responsible for securing pets, valuables, and ensuring that children stay clear of work areas.

Work sites can be dangerous. You agree to follow all safety instructions and keep unauthorized persons away from active work areas. We are not responsible for injuries to persons who enter work areas without authorization or who fail to follow posted safety warnings.

Dispute Resolution

Any disputes arising from these terms or our services shall first be addressed through good faith negotiations between parties. If resolution cannot be reached, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

These terms are governed by the laws of the State of Florida. Any legal action must be brought in the courts of Miami-Dade County, Florida. You agree to waive any right to a jury trial in any proceeding arising out of or related to these terms or our services.

Changes to Terms

We reserve the right to modify these terms at any time. Changes become effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.

Individual service contracts may contain additional terms specific to your project. In case of conflict between these general terms and your service contract, the specific contract terms shall prevail.
